Fantasy Court provides an arena to solve Fantasy Sorts disputes in a quick, fun and efficient network.  Our site facilitates discussion, opinion sharing and ultimately helps bring community wisdom to fantasy disputes.  FantasyCourt provides an opportunity to engage a community of passionate users and collaborate on issues that interest them. We do ask that you treat our service and community with respect. Spam, personal attacks, and abusive language do not have a place in The FantasyCourt. If you ever stumble across anything on the FantasyCourt that looks like it violates our policies, please be sure to let us know.

Accepting the Terms of Service

Fantasy Court (“Site” or “Service” is a set of related websites that facilitate interaction within a community to help enable discussions, opinions and provide insights into user generated questions/disputes.  FSC and related sites are owned and operated by Fantasy Court Inc. Please read these terms of service (“Agreement”) carefully before using FSC or any services provided by our site. By using or accessing the Services, you agree to become bound by all the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, do not use the Services. The Services are accessed by You (“User” or “You”) under the following terms and conditions:

Service

FantasyCourt provides a place for people to engage in conversation, an outlet for opinions and a tool to utilize the wisdom of our community to provide a potential resolution to user generated/posted disputes.

FantasyCourt allows permission to use the site as set forth in this Agreement, provided that:

  1. You will not copy, distribute, or disclose any part of the site in any medium;
  2. You will not alter or modify any part of FantasyCourt.com
  3. You will otherwise comply with the terms and conditions of this Agreement.

You will need to register with FantasyCourt and create a “Member” account. Your account gives you access to the services and functionality that we may establish and maintain from time to time and in our sole discretion.

When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You are responsible to make FantasyCourt aware of any breach of security or unauthorized use of your account. FantasyCourt will not be liable for your losses caused by any unauthorized use of your account.  You will however be responsible/liable for the losses that occur to FanatsySportCourt or others due to such unauthorized use.

By providing FantasyCourt your email address, you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, including changes to features of the Service and special offers.

You agree neither to collect or harvest any personally identifiable information, including account names from FantasyCourt nor to use the communication systems provided by the Service for any commercial solicitation purposes. You agree not to use any portion of FantasyCourt for purposes of sending unsolicited bulk messages or unsolicited commercial messages.

FantasyCourt can permanently or temporarily terminate, suspend, or otherwise refuse to permit your access to the site without notice and liability, if, in FantasyCourt’s sole determination, you violate any of the Agreement, including the following prohibited actions:

  1. Attempting to interfere with, compromise the FantasyCourt.com’s integrity or security or decipher any transmissions to or from the servers running the FanatsySportCourt.com;
  2. Imposing or engaging in activities that potentially impose, at our sole discretion, an unreasonable load on our infrastructure;
  3. Uploading viruses, worms, or other software agents through FantasyCourt.com;
  4. Impersonating another person or conducting fraud
  5. interfering with the proper working of the FantasyCourt.com

Upon termination for any reason, you continue to be bound by this Agreement.

FantasyCourt reserves the right to offer alternative and/or additional Services to certain administrative users that may not be offered to general Users. You acknowledge that FantasyCourt may charge a fee for the use of any Services, provided that FanatsySportCourt notifies you of any such fee before you incur it. Subject to the foregoing, you agree to pay any fees incurred by you.

User Content

Our Service allows Users to post opinions, comments, questions, data, and other information (“User Content”). You are solely responsible for your User Content that you upload, publish, display, link to or otherwise make available (hereinafter, “post”) on the Service, and you agree that we are only acting as a passive conduit for your online distribution and publication of your User Content.

All the opinions, data, comments, votes and user content on FanatsySportCourt.com does not represent the views of FanatsySportCourt. FanatsySportCourt takes no responsibility and assumes no liability for any User Content that you or any other Users or third parties post or send over the Service. You understand and agree that any loss or damage of any kind that occurs as a result of the use of any User Content that you send, upload, download, stream, post, transmit, display, or otherwise make available or access through your use of the Service, is solely your responsibility. Inclusive of User Content, is verdicts/results of community generated disputes.  Verdicts/results are based on community participation and therefore all above User Content terms of use apply to those events.

In addition,

  1. FanatsySportCourt does not propose to have any jurisdiction or propose to have any binding authority on the disputes loaded in the service
  2. FantasyCourt is not liable for any verdicts rendered and the any outcomes that may result from those verdicts, opinions and discussions.
  3. FanatsySportCourt does not interfere with the outcomes. You have sole responsibility for votes, comments posted through the service.  

You understand and acknowledge that you may be exposed to User Content that is inaccurate, offensive, indecent, or objectionable, and you agree that FantasyCourt shall not be liable for any damages you allege to incur as a result of such User Content.

You are solely responsible for your interactions with other FanatsySportCourt Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users.

You agree not to post User Content that:

  1. May create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal;
  2. May create a risk of any other loss or damage to any person or property;
  3. May constitute or contribute to a crime or tort;
  4. Contains any information or content that is unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, or otherwise objectionable;
  5. Contains any information or content that is illegal;
  6. Contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or
  7. Contains any information or content that you know is not correct and current. You agree that any User Content that you post does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights (as defined below), rights of publicity and privacy.

Changes

FantasyCourt reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Service following the posting of any changes to this Agreement constitutes acceptance of those changes. FantasyCourt may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

Indemnity

Subscriber will indemnify and hold FantasyCourt, its directors, officers and employees, harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of a Users access to the Network, use of the Services, the violation of this Agreement by User, or the infringement by User, or any third party using the Subscriber's account, of any intellectual property or other right of any person or entity.

Limitation of liability

In no event shall FanatsySportCourt, its directors, officers, shareholders, employees or members be liable with respect to the Network or the Services for

  1. Any indirect, incidental, punitive, or consequential damages of any kind whatsoever;
  2. Damages for loss of use, profits, data, images, Subscriber Content or other intangibles;
  3. Damages for unauthorized use, non-performance of the Network, errors or omissions; or
  4. Damages related to downloading or posting Content.

Disclaimer of Warranties

FantasyCourt.com is provided “as is”. FanatsySportCourt hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. FantasyCourt does not make any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.

Third party websites

Users of FantasyCourt.com may gain access from the site to third party sites on the Internet through hypertext or other computer links on FantasyCourt.com. Third party sites are not within the supervision or control of FantasyCourt. Unless explicitly otherwise provided, FantasyCourt does not make any representation or warranty whatsoever about any third party site that is linked to the Service, or endorse the products or services offered on such site. FantasyCourt disclaims:

  1. All responsibility and liability for content on third party websites and
  2. Any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) You might be requested to give any third party, and You hereby irrevocably waive any claim against the FantasyCourt with respect to such sites and third party content.

Intellectual Property.

This Agreement does not transfer from FantasyCourt to you, any FanatsySportCourt or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with FanatsySportCourt. FanatsySportCourt’s logo, and all other trademarks, service marks, graphics and logos used in connection with FanatsySportCourt.com, or the Website are trademarks or registered trademarks of FanatsySportCourt. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any FanatsySportCourt or third-party trademarks.  Further, FanatsySportCourt’s process, branding, model and development including intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with FanatsySportCourt

Miscellaneous

This Agreement (including the Privacy Policy), as modified from time to time, constitutes the entire agreement between You and FanatsySportCourt with respect to the subject matter hereof. This Agreement replaces all prior or contemporaneous understandings or agreements, written or oral, regarding the subject matter hereof. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. FanatsySportCourt shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond FantasyCourt reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. This Agreement is not assignable, transferable or sublicensable by User except with FanatsySportCourt’s prior written consent.
